DEEPAK GUPTA , J.(Oral) The suit for recovery of `1,13,740/- was filed by plain%ff – M/s Longowal Brick Kiln owner through its partners, namely Parkash Chand and Pawan Kumar (respondent herein). The suit was decreed on 07.12.1998 by the trial Court and the appeal of the defendant–appellant was dismissed by the First Appellate Court on 31.08.2000. 2. The concurrent findings of the Courts below were assailed by the defendant before this Court by way of present regular second appeal. 3. Learned counsel for the defendant-appellant informs this Court that as per instruc%ons available with him, since there was no stay, the payment of decretal amount to the respondent-plain%ff has already been made. 4. As per report of the Registry, one of the partners, namely, Parkash Chand has already expired; whereas the par%culars of other partner, namely, Pawan Kumar are not traceable. Learned counsel submits that he is unable to trace any other address of said Pawan Kumar. It is also informed that in fact, the firm of the respondent stands closed long back. 4. Having regard to the aforesaid facts and circumstances and the fact that the payment has already been made to the respondent-firm by the appellant, as stated by learned counsel for the appellant, the present appeal stands disposed of, having been rendered infructuous.
