The Court made the following order: The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/Accused on bail in Crime No.103 of 2025 of Rajahmundry Police Station, GRP Vijayawada District, registered against the Petitioner/Accused herein for the offences punishable under Sections 8(c) read with 20(b)(ii)(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for brevity ‘the NDPS Act’). 2. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. 3. The learned counsel for the petitioner submits that only 14 Kgs of alleged Ganja was recovered and seized from the possession of the petitioner. It is not a commercial quantity. The petitioner was falsely implicated in this case. He has not committed any offence. He is the sole bread winner of his family. He has got fixed abode. He was abide by any condition, if he is enlarged on bail and it is urged to allow the petition. 4. The learned Assistant Public Prosecutor submits that in a conspiracy to transport 154 kgs of Ganja, the petitioner and other accused got purchased 154 kgs of Ganja and they are trying to transport to different destinations. Section 29 of ‘the NDPS Act’ would apply to the case on hand and it is urged to dismiss the petition. On perusal of the record, the petitioner was spot- arrested while he was in possession of 14 kgs of Ganja. The investigation is in a nascent stage. So far, only four witnesses are examined and some more

witnesses are yet to be examined. Prima facie, Section 29 of ‘the NDPS Act’ would squarely apply to the case on hand.
