HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 26/09/2025
1. These second bail applications have been filed under Section 483 of BNSS on behalf of the petitioners, who have been arrested in connection with FIR No.114/2025 registered at Police Station Renwal, District Jaipur Rural (Rajasthan) for offences punishable
[2025:RJ-JP:39766] (2 of 3) [CRLMB-12430/2025] under Sections 115(2), 126(2), 140(3) and 308(2) of the Bharatiya Nyaya Sanhita, (in short ‘BNS’) 2023. After completion of investigation, police filed charge-sheet in this matter for offences punishable under Sections 115(2), 126(2), 140(2), 127(2) and 310(2) of BNS, 2023. 2. The first bail applications preferred on behalf of the petitioners were dismissed by this Court vide order dated
04.08.2025. Now, these second bail applications have been preferred by the petitioners. 3. It is contended by learned counsel for the petitioners that petitioners have falsely been implicated in this case. Counsel submits that parties have resolved their dispute amicably. Counsel submits that there are no criminal antecedents against petitioner- Kaluram Burdak @ Kartik whereas two other cases have been registered against petitioner- Virendra. It is submitted that trial will take considerable time in its conclusion. Counsel submits that petitioner- Kaluram Burdak @ Kartik is in custody since 27.04.2025 whereas petitioner- Virendra is in custody since 09.05.2025 and further custody of the petitioners would not serve any fruitful purpose. 4. Learned Public Prosecutor opposes the prayer for bail made by learned counsel for the petitioners. 5. I have considered the contentions. 6.
Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioners, especially considering the fact that parties have resolved their dispute amicably, so also the fact that
[2025:RJ-JP:39766] (3 of 3) [CRLMB-12430/2025] charge-sheet has been filed in this matter and trial will take considerable time in its conclusion as well as looking to the period of custody, but without commenting anything on the merits/demerits of the case, I deem it fit and proper to allow these second bail applications. 7. These second bail applications are accordingly allowed and it is directed that accused-petitioners (1) Virendra S/o Omprakash and (2) Kaluram Burdak @ Kartik S/o Shri Shivram Burdak shall be released on bail provided each of them furnishes a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) together with two sureties in the sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each to the satisfaction of the learned Trial Court with the stipulation that they shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so. 8. Learned trial Court shall verify the factum of compromise by ensuring the presence of complainant- Vikas Thirania through Investigating Officer before accepting the bail bonds. 9. The observations made hereinabove are only for decision of the bail applications and would not have any impact on the trial of the case in any manner. (ANIL KUMAR UPMAN),J LALIT MOHAN /84-85
