Respondent(s) (Cause Title is taken from Case Information System) For Petitioner : Mr. Pawan Shrivastava, Advocate For State : Mr. Rajeev Bharat, Government Advocate Hon'ble Shri Justice Rakesh Mohan Pandey Order on Board 10 .01.2025 1. By way of this petition, the petitioner has sought the following relief(s):- “10.1 That, this Hon'ble Court may kindly call for the entire record relating to the case of the petitioner. 10.2 That, this Hon'ble Court may kindly be pleased to direct the respondents to consider the case of petitioner and direct to arrange Written Examination' for the post 2 of Constable(GD) Disctrict- Bilaspur, petitioner either one post of Constable (GD) Disctrict- Bilaspur, shall keep vacant for the petitioner. 10.3 That, this Hon'ble Court may kindly be pleased to direct the respondents not to fill up one post of Constable(GD) Disctrict-Bilaspur, against which the petitioner was appearing in the selection process. 10.4 Any other relief as this Hon'ble Court may deems fit may also be awarded.” 2. Learned counsel for the petitioner submitted that an advertisement was issued for various posts of Constable(GD) in the year 2017. The petitioner submitted his application along with relevant documents on 26.01.2018. He would further submit that the petitioner participated in the physical efficiency test on 20.05.2018 and he qualified it, but he was not permitted to appear in the written examination. The petitioner inquired with the respondent authorities then he came to know that the name of his father was wrongly mentioned in the mark-sheet of Class Xth as “Ram Verma”. Thereafter, “Latel” word was included in the mark-sheet of Class Xth by the Deputy Secretary of Chhattisgarh State Open School, Raipur. He would also submit that the document along with an application was moved prior to the date of examination i.e. 30.09.2018. It is contended that the respondent authorities failed to consider the claim of the petitioner to permit him in the written examination. It is further contended that by virtue of the interim order, one post has been kept vacant. 3. On the other hand, Mr. Rajeev Bharat, Government Advocate appearing for the State would oppose. He would submit that there was some discrepancy in the name of the father of the petitioner in the Class Xth mark-sheet; therefore, the petitioner was not permitted to appear in the written examination. He would further submit that the petition was filed in the year 3 2018; the written examination has already been conducted; and the selected candidates have already been appointed; therefore, the instant petition deserves to be dismissed. 4. I have heard learned counsel for the parties and perused the documents placed on the record. 5. It appears that the petitioner was not permitted to appear in the written examination as there was some discrepancy in the name of his father. The petitioner filed the mark-sheet with the correct name of his father prior to the date of the written examination and a representation was also moved, however, neither the document nor the representation was taken into consideration by the authorities. By virtue of interim order, one post is still lying vacant; therefore, at this juncture, this petition is disposed of with a direction to the respondent authorities to consider the candidature of the petitioner as the petitioner has already filed a rectified mark-sheet of Class Xth. 6. With the aforesaid observation(s), and direction(s), the instant petition is hereby disposed of. Sd/- (Rakesh Mohan Pandey) Judge $iddhant
