GP FOR REVENUE The Court made the following order: The short grievance of the petitioner is that, the respondent authorities are trying to dispossess them from the house site admeasuring Ac.0.02 cents in Sy.No.597-1B situated at Gundipudi village, Pothulavari pet, Deguptam Post, Allavaram Mandal, Dr.B.R.Amedkar Konaseema District without following due process of law. 2. Heard Sri P.V.V.Satyanarayana, learned counsel for the petitioner, Sri Bala Krishna, learned Assistant Government Pleader for Panchayat Raj Department and Sri Y.Koteswara Rao, learned Standing counsel for Gram Panchayat. 3. When the matter is taken up for consideration, Sri Y.Koteswara Rao, learned Standing counsel for Gram Panchayat on instructions dated 23.12.2025 submitted that the subject land is Government land and the petitioner has encroached the same and making constructions in the subject land. As such no indulgence need be shown on the petitioner and prayed to dismiss the writ petition. 4. It is well settled principle of law that even an encroacher is entitled for a reasonable notice. Having admitted that the petitioner is an encroacher, the respondents have not issued any notice to the petitioner as per the settled principle of law. In view of the same, this Court is inclined to dispose of the writ petition with the following direction: The respondent authorities are directed not to interfere with the subject property except under due process of law. Accordingly, the writ petition is disposed of. No costs. Miscellaneous applications, pending if any, shall stand closed. ________________________ JUSTICE RAVI CHEEMALAPATI BRS
