1 IN THE HIGH COURT OF JHARKHAND AT RANCHI W.P.(S). No. 648 of 2025 1. Ram Murmu, aged about 35 years, S/O late Junas Murmu, R/O Village – Amrapara Santhali, P.O. & P.S. – Amrapara, District – Pakur. 2. Pinki Murmu, aged about 27 years, W/O Manjhi Tudu, R/O Village – Amrapara Santhali, P.O. & P.S. – Amrapara, District – Pakur. … … Petitioners Versus 1. State Bank of India through its Chairman & Managing Director, State Bank Bhavan, 14th Floor, Madame Cama Road, Nariman Point P.O. & P.S. – Nariman Point, Mumbai, 400021, Maharastra. 2. The Regional Manager, State Bank of India, RBO, Region III, P.O. & P.S. – Amrapara, District – Pakur. 3. The Branch Manager, State Bank of India, RBO, Region III, P.O. & P.S. – Amrapara, District – Pakur. 4. Chhita Marandi, aged about 29 years, W/O late Joseph Murmu, R/O Village Amrapara Santhali, P.O. & P.S. – Amrapara, District – Pakur. … … Respondents --- CORAM : SRI ANANDA SEN, J. --- For the Petitioner : Mr. Rakesh Kumar, Advocate For the Resp.-SBI : Mr. Rajesh Kumar, Advocate : Mr. Amit Kumar, Advocate : Mr. M. K. Sinha, Advocate --- 03/12th February 2025 1. The matter relates to payment of ex-gratia lump-sum amount in lieu of the death of the employee of State Bank of India who was the mother of petitioner nos. 1 and 2 and mother-in-law of respondent no. 4. 2. Considering the nature of order which I intend to pass, it is not necessary to either notice the respondent no. 4 and or to direct them to file counter affidavit. Earlier one of these petitioners namely Ram Murmu has approached this Court by filing W.P. (S). No. – 1732 of 2019 claiming compassionate appointment on the ground that his mother died in harness while she was working as a Senior Messenger, State Bank of India, Amrapara Branch, Pakur. 3. After considering the claim of the petitioner, this Court held that no compassionate appointment can be granted in this case but the 2 bank was directed to pay the ex-gratia amount which the heirs of the deceased are entitled to receive, along with interest @ 6.5% per annum. The bank accepted the said order and deposited the entire amount in an interest bearing account. The principle amount with 6.5% interest is lying with the bank, in an interest bearing account. 4. Now this writ application has been filed by one son and daughter of the deceased employee stating therein that their sister-in-law (wife of the pre-deceased brother) is not co-operating thus they are not being able to withdraw their share of the said amount. 5. From the pleadings of the parties, I find that the deceased had three legal heirs i.e., two sons and one daughter. As per the argument, I understand that one of the sons namely, Joseph Murmu is dead and is survived by his wife Chinta Maranti i.e., respondent no. 4. 6. It is case of the petitioners that she is not co-operating, as a result of which, both these petitioners are not in a position to withdraw the ex-gratia amount. 7. Considering the peculiar situations, I direct the Bank to pay these two petitioners 1/3rd of the total amount each which is lying with the bank as on date within a period of four weeks subject to production of the documents from which the identity of these two petitioners could be established. The remaining amount should be disbursed to respondent no. 4 as and when respondent no. 4 approaches with necessary documents to the Bank. 8. Accordingly, with the aforesaid observations and directions, this writ petition is disposed of. (ANANDA SEN, J.) Aditi
