HC-KAR NC: 2025:KHC:32968 WP No. 20712 of 2025 Pleader raises a preliminary objection to the maintainability of the writ petition, while contending that the notices are issued by the Deputy Tahsildar calling upon the petitioners to vacate the lands in question, which do not belong to the petitioners and that they are public property. Learned High Court Government Pleader submits that when a competent authority has issued notice, the petitioners are required to give a reply and participate in the proceedings that could be taken up by the competent authority.
3. There is substance in the submission made by the learned High Court Government Pleader.
4. The writ petition is accordingly disposed of while reserving liberty to the petitioners to give a reply to the notices issued by the Deputy Tahsildar. The Deputy Tahsildar or the competent authority shall afford an opportunity of hearing to the petitioners before any step is taken to evict the petitioners from the lands in question.
Ordered accordingly.
