ORDER:
This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:
“….to issue a Writ, order or a direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents, more particularly the 4th Respondent in issuing the notice and dated, received by the petitioner on 16.06.2019 and his personal visits and extending threats to the employees of the Petitioner to hand over the pledged gold ornaments in respect of loan amounts sanctioned to Sankili Pradeep Kumar under the guise of registration of FIR No.177/2019 under Section 420 and 417 IPC against the borrower and interference with the day-to-day business activities of the Petitioner's Company without following due process of law as illegal, unwarranted, unsustainable, arbitrary against Law as well as principles of natural justice and consequently set aside the notice issued by the 4th Respondent and direct the Respondents to not to interference with the business activities of the Petitioner without following due process of law……”
2. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home. 3. The written instructions submitted by the learned Assistant Government Pleader for Home on the previous adjournment would disclose that police completed investigation in Crime No.177 of 2019 of MVP Police Station, Visakhapatnam City, and laid charge sheet vide C.C.No.4319 of 2019 on the file of the learned IV Additional Chief Judicial Magistrate, Visakhapatnam, and the same is pending for trial. 4. The writ petition was filed alleging that police are not conducting investigation in the above crime.
Now, police completed investigation and laid charge sheet. 3
5. In that view of the matter, no further orders are required in the writ petition. 6. Accordingly, the Writ Petition is closed at the stage of admission, without going into the merits of the case. There shall be no order as to costs. As a sequel thereto, interlocutory applications, if any, pending in this Writ Petition shall stand closed. ______________________________ JUSTICE B.V.L.N.
