Mr. Anubhav Chandra, learned advocate, Standing Counsel appears on behalf of State and with reference to our order dated 23rd April, 2025 hands up documents including report dated 13th April, 2025. He submits, the report says that respondent no.4 obtained sanction on his building plan. There is provision for basement. Basement work has not yet commenced. There is, at present, no danger to petitioner's property, adjacent. Copies of the documents have been given to Mr. Satish Kumar Mishra, learned advocate appearing on behalf of petitioner. 2. Mr. Satish Kumar Mishra submits, the plan was illegally sanctioned. His client's objection dated 3rd May, 2025 against the plan given to the District Magistrate, was not considered. Mr. Ashok Kumar Tiwari, learned advocate appears on behalf of respondent no.4. He submits, his client is present in Court and will construct strictly according to the sanctioned plan. 3. On query Mr. Tiwari submits on instructions obtained, his client will ensure that no damage is caused to petitioner's property consequent to him making construction in his property. 4.
