Consequently directing the respondents to release the terminal benefits with interest of the petitioner as he entitled and to pass Counsel for the Petitioner: A PADMA Counsel for the Respondents: GP FOR COOPERATION (AP) Counsel for the Respondents:SHAIK SHAHEDAZ The Court made the following order: 3 HON’BLE SRI JUSTICE MAHESWARA RAO KUNCHEAM WRIT PETITION No.28228 OF 2015 ORDER: The present writ petition is filed by the petitioner under Article 226 of Constitution of India seeking the following relief: “to issue a Writ or Order or direction more particularly one in the nature of Writ of Mandamus under Art. 226 of Constitution of India, declaring the action of respondents though the petitioner was retired in the year 2008, and he is entitled for Gratuity and Encashment of Earned Leave not releasing retiral benefits to the petitioner till date is as illegal, arbitrary and void. Consequently directing the respondents to release the terminal benefits with interest of the petitioner as he entitled and to pass…..” 2. Today, when the matter is taken up for hearing, learned counsel Sri K.Anish, representing Sri Shaik Shahedaz, learned counsel for the respondents 2 and 3 submits that all the retirement benefits due to the petitioner were paid to the petitioner and no further orders need be passed in the present writ petition. To that effect, he produced the letter dated 20.09.2024 addressed by the petitioner to the 2nd and 3rd respondent authorities before this Court, where the petitioner reiterated about receipt of all his terminal benefits. 4 3. The said submission of the learned counsel for respondents 2 and 3 is not disputed by the learned counsel for the petitioner Smt.A.Padma. 4. Taking into consideration the facts and circumstances of the case and also placing the letter dated 20.09.2024 addressed by the petitioner to the respondents 2 and 3 on record, the writ petition is closed. There shall be no order as to costs.
