HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 6249 of 2012 Court No. - 40 HON'BLE SARAL SRIVASTAVA, J.
HON'BLE AMITABH KUMAR RAI, J.
1. Heard learned counsel for the petitioner, learned Standing Counsel for the State-respondents and Sri Rakesh Kumar Tripathi,(Adv. Roll A/R 0673/20123) holding brief of Sri Narendra Kumar Tiwari, learned counsel for respondent no.1 & 2. 2. The petitioner by means of the present writ petition has assailed the order dated 11.01.2012 passed by the Consumer Grievance Redressal Forum, Allahabad in Complaint/Application No.39 of 2011 whereby the Consumer Grievance Redressal Forum, Allahabad has allowed the the relief partly to the petitioner and reduced the Bill of the petitioner from Rs.64,47,683/- to Rs.30,71,641/-. 3. It is contended by learned counsel for the petitioner that the impugned order has been passed without application of mind as no reason whatsoever has been assigned by the Consumer Grievance Redressal Forum, Allahabad in concluding that the petitioner is liable to pay Rs.30,71,641/-. It is contended that there was no material on record which establishes that the petitioner is liable to pay any amount, and in such view of the fact, the impugned order cannot be sustained in law. 4. The writ petition has been filed in the year 2012 and more than 13 years have been passed and Department has not yet filed counter affidavit. 5. Considering the nature of order being passed in the present case, this Court does not deem fit to grant further time to the respondents for filing Versus Counsel for Petitioner(s) :
B.C. Rai Counsel for Respondent(s) : Mahboob Ahmad, Narendra Kumar Tiwari, S.C., Subham Gosai M/S Sagar Wire Pvt. Ltd. .....Petitioner(s) Purvanchal Vidyut Vitran Nigam Ltd. And Others .....Respondent(s)
counter affidavit. 6. Since the perusal of the impugned order reveals that the order is cryptic and without any reason inasmuch as the Consumer Grievance Redressal Forum while reducing the amount of bill to Rs.30,71,641/- has not recorded any reason as to how the petitioner is liable to pay Rs.30,71,641/-, in such view of the fact, the impugned order 11.01.2012 is set aside to the extent the petitioner is directed to pay Rs.30,71,641/- and the matter is remanded to the Consumer Grievance Redressal Forum, Allahabad to decide the matter afresh to the extent it holds the liability upon the petitioner to Rs.30,71,641/-. 7. Consequently, the writ petition is allowed.
