1. The present writ petition has been filed for the following relief:-
“For quashing a notice dated 21.06.2021 issued by the respondent No.2 (Annexure-3) asking the petitioner to show cause against the alleged encroachment over land being portion of Plot No.293 under Khata No.2 in Ward No.4 and for an appropriate writ or order or direction directing the respondent No.2 to consider show cause dated 20.09.2021 filed by the petitioner (Annexure-5) before passing any final order.”
2. It has submitted by the learned counsel for the State that a proper reply has been filed by the petitioner in response to the notice (Annexure-4) of the present writ petition which has been issued by the S.D.O., Dhalbhum, Jamshedpur in Misc Case No.208 of 2021.
3. At present, the writ petitioner wants that any decision should be taken after considering the reply. The fair procedure is the right of every citizen.
4. In that view of the matter, the present writ petition is hereby, disposed of directing the respondents to give an opportunity of effective hearing to the petitioner, and after considering the point raised by the petitioner proceeding should be culminated.
5. The petitioner is at further liberty to avail his further remedy in accordance with law.
