1. The petitioner has filed this petition assailing the order dated 22.08.2025 passed by Divisional Forest Officer, Jagdalpur, Bastar, by which his services has been terminated on the count that the petitioner was absent in service of 446 days. Counsel for the petitioner would submit that the petitioner has submitted explanation for his absenteeism in service along with the relevant documents which has not been considered by the respondents and in a mechanical manner the order has been passed. He would further submit that the petitioner services is governed under CCA Rules 1966 and according to Rule 10 termination from service is major penalty and as per Rule 27 of CCA, the petitioner has remedy of filing of an appeal before the Appellant Authority.
3. Considering this aspect of the matter, the writ petition is disposed of. However, granting liberty to the petitioner that if an appeal is filed by him within 30 days from the date of receipt of the copy of the order, the Appellant authority shall decide the appeal on merit without insisting for delay, as this Court has already condoned the delay in not filing the appeal in time.
