IN THE HIGH COURT OF JHARKHAND AT RANCHI
Cont. Case (Civil) No. 63 of 2024
M/s Shri Khatu Shyam Udyog, East Singbhum, through its proprietor, Shri Shyam Sunder Sharma
….. Petitioner
Versus The General Manager-cum-Chief Engineer, JBVNL, Electricity Supply Area, East Singhbhum
….. Opposite Party
-----
CORAM
HON’BLE MR. JUSTICE RAJESH SHANKAR
----- For the Petitioner: Mr. M. S. Mittal Sr. Adv. For the O.P:
Mr. Manoj Kumar, Sr. S.C (JBVNL)
-----
05/09.05.2025 The present contempt application has been filed against the opposite party alleging wilful disobedience and non-compliance of the order dated 14.02.2023 passed by this Court in W.P.(C) No. 5836/2022.
Having heard learned Sr. counsel for the petitioner and considering that in compliance of the aforesaid order of this Court, an order has already been passed by the opposite parity on 06.02.2024 (Annexure-A to the show cause affidavit dated 12.03.2024) rejecting the petitioner’s claim for refund, I see no reason to further proceed with the matter.
The contempt proceeding as against the opposite party is dropped.
The present contempt application stands disposed of.
The petitioner is however at liberty to take appropriate recourse as available under law against the order dated 06.02.2024 passed by the opposite party. Satish/-
