Y L SIVAKALPANA REDDY(SC CUM SPL PP,CID) The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus to declare the action of the Official Respondents particularly Respondent Police Officials having received several complaints from 8.4.2022 onwards basing on which several FIRs registered at different districts and also received reports by 3rd Respondent District Collector along with the Respondent No 4 the DCO preliminary report and having registered and invoked section 5 of AP Protection of Depositors of Financial Establishments Act 1999 against all the Managing-Directors and others of 13th Respondent Jaya lakshmi Mutually Aided Multipurpose Cooperative Society Limited neither arresting nor attaching properties and deliberately delaying in handing over the investigation into this hundreds of crores of Financial fraud and Economic Offenses case to the CID department and not making any efforts to constitute a Special Court despite of clear provisions of the Act is illegal and unlawful, against the article 14 and 21 of constitution of India against fair investigation besides being violating the provisions of AP Protection of Depositors of Financial Establishments Act 1999 consequently direct the Official respondents particularly the present investigation agency the 2nd Respondent CB CID to act swiftly by immediately appointing a fair and competent Investigation officer and further direct the 1st Respondent to constitute a Special Court to adjudicate this offence as per the special Act in view of the seriousness and the wider nature this economic offence spreading to 6 districts covering 29 branches with a huge amount nearly 458 crores of belonging the members of 19,000 depositors accounts are defrauded diverted and swindled violating all laws by all the Managing Committee members,Auditors and all brach Managers of the 13th Respondent Jaya Lakshmi Mutually Aided Multipurpose Cooperative Society Ltd forthwith and prosecute them thereby ensure protection to the innocent victim depositors in returning their moneys thus render justice in the cases.” 3 2. Sri V.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that, the matter is of civil nature and the Police are not interfering with the civil disputes between the parties. 3. None represented for the Petitioner. 4. Considering the submissions made, the Writ Petition is disposed of. However, Petitioner is at liberty to work out their remedies before appropriate forum in accordance with law. There shall be no order as to costs.
