This is an application filed by the election petitioner under Section 151 of CPC, 1908 read with Rule 94 of the Conduct of Election Rule, 1961 praying for a direction to the Election Commission of India (Proforma respondent No. 2) and the Returning Officer, No. 36 Nari Koyu (ST), Assembly Constituency (Proforma respondent No. 3) to preserve the documents, records including voting machines, control units, CCTV footages of No. 36 Nari Koyu (ST), Assembly Constituency for the Assembly Election held on 19.04.2024. Mr. Gyatso, learned counsel for the applicant submitted that the documents and voting machines etc. will be required at the time of hearing the election petition No. 04/2024. Mr. Dabi, learned counsel appearing for the respondent raised no objection Page No.# 3/3 and submitted that he has no objection if the order for preservation of documents etc. is passed by this Court. After hearing the submission made by the learned counsel for both sides, accordingly, the Election Commission of India and the Returning Officer are hereby directed to preserve all the records and documents till the disposal of the connected election petition No. 04/2024.
