Order on Board 23/01/2025 Heard.
1. By the present writ petition the petitioner who is owner of land bearing Khasra Nos. 129/9, 128/2 and 39/4 admeasuring 0.1298, 0.0261 and 0.0541 hectares situated at Gram Junwani, Revenue Circle Junwani, Tehsil and District Durg is aggrieved by the order dated 21.10.2024 (Annexure P-1), 06.06.2024 (Annexure P-2) and Annexure P-3 by which the Senior Deputy Registrar has restricted purchase and sale of the land owned by the petitioner.

Learned counsel for the petitioner submits that the Commissioner, Municipal Corporation approached the Deputy Registrar by its communication dated 06.06.2024 alleging illegal plotting made by the petitioner for sale of land in question. He further submits that the petitioner is not making any plotting on the land, however, the petitioner wish to sale the land owned by him within the permissible limit.
3. Learned counsel for the Municipal Corporation, on instructions, would submit that if the petitioner wish to sell the land within permissible limit, then the
3 Municipal Corporation has no objection to the contention of the petitioner and he may sell the land owned by him within permissible limit of land transactions without any plotting.
4. Learned State counsel reiterated the submissions made by the counsel for the municipal corporation.
5. I have heard learned counsel for the parties and perused the restriction imposed by the Senior Deputy Registrar, Durg.
6. Perusal of order of Senior Deputy Registrar shows that the order of restriction of sale has been imposed on the basis of the communication made by the Commissioner, Municipal Corporation, wherein it has been alleged that the petitioner is selling his land by making illegal plotting of the said land which is not permissible under the law. Presently, as the petitioner is stating that the petitioner wish to sell the total land owned by him within permissible limit of land transactions, there is nothing left to adjudicate, at this stage and it is
directed that the petitioner be permitted to sell his land without making any plotting within permissible limit of land transactions. The petitioner is directed to intimate the Municipal Corporation at the time of sale of land.
7. With the aforesaid observation, the petition stands disposed off. Sd/-
