Lalit Kaushik and others, arising out of Case Crime No. 467 of 2023, under Section 3(1) U.P. Gangster and Anti Social Activities (Prevention) Act, 1986, Police Station Civil Line, District Moradabad, pending before the Special Judge (Gangster Act)/ Additional Sessions Judge, Court No.6, Moradabad to some other district. When the case is called out, no one has appeared on behalf of applicant. Learned A.G.A. is present. A perusal of the application would show that the applicant-accused is aggrieved against recording of his explanation under Section 313 Cr.P.C. through video conferencing. Since, the proceedings have been conducted during trial and if, the accused has any grievance, he can challenge the said order by availing the statutory remedy and the said ground cannot be construed as a valid ground for transfer of the subject case. The application is dismissed.
