PUBLIC PROSECUTOR The Court made the following: COMMON ORDER: These Criminal Petition Nos.11737, 11738, 11739, 11742, 11749 and 11753 of 2025 have been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the Petitioner/Accused No.9, Petitioner/Accused No.14, Petitioner/Accused No.3, Petitioner/Accused No.12, Petitioner/Accused No.13, and Petitioner/Accused No.8 respectively for granting of pre-arrest bail in connection with Crime No.121 of 2025 of B.N.Kandriga Police Station, Tirupati District, registered for the alleged offence punishable under Sections 191(2), 191(3), 109(1) read with 190 of the Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS’). 2. These Criminal Petition Nos.11737, 11738, 11739, 11742, 11749 and 11753 of 2025 are heard and disposed of by way of this common order, as the petitioners in these criminal petitions are accused in the same crime. 4 3. Heard the learned Counsels for the Petitioners and the learned Assistant Public Prosecutor. 4. As seen from the record, it is the allegation of the prosecution that the Petitioners and other accused on 08.10.2025 came on a car and four motorcycles holding sticks, rods and knives. It is alleged that the Petitioners and other accused tried to hit the de-facto complainant with the car, but the de-facto complainant escaped. The Petitioners and other accused have attempted to attack the de-facto complainant with knives, rods and sticks. However, the de-facto complainant escaped from their clutches and lodged a report. 5. Learned Assistant Public Prosecutor submits that wound certificate has not yet been received. Accused No.1 was arrested on 09.10.2025 and he was enlarged on bail by this Court in Crl.P.No.11647/2025, after forty days in the judicial custody. This Court has granted pre arrest bail to the accused No.10 in Crl.P.No.11648 of 2025 on 19.11.2025. 6. It appears that there are land disputes between the Petitioners’ group and the de-facto complainant’s group. The police have advised both groups to settle the disputes in the presence of the Tahsildar of the concerned Mandal. The wife of Accused No.1 lodged a report on 21.10.2025 against the de-facto complainant and some other persons, that report was registered as a case in Crime No.124 of 2025 for the offences punishable under Sections 131, 329(4), 115(2), 351(2), 79 and 324(5) read with 3(5) of the BNS, and Sections 3(1)(r), 5 3(1)(s), and 3(2)(va) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989. 7. Considering the facts and circumstances of the case, gravity and nature of the allegations levelled against the Petitioner/Accused No.9 in Crl.P.No.11737 of 2025, Petitioner/Accused No.14 in Crl.P.No.11738 of 2025, Petitioner/Accused No.3 in Crl.P.No.11739 of 2025, Petitioner/Accused No.12 in Crl.P.No.11742 of 2025, Petitioner/Accused No.13 in Crl.P.No.11749 of 2025 and Petitioner/Accused No.8 in Crl.P.No.11753 of 2025, this Court is inclined to grant pre-arrest bail to the Petitioners. 8. In the result, the Criminal Petition Nos.11737, 11738, 11739, 11742, 11749 and 11753 of 2025 are allowed with the following conditions: i. In the event of arrest of the Petitioner/Accused No.9 in Crl.P.No.11737 of 2025, Petitioner/Accused No.14 in Crl.P.No.11738 of 2025, Petitioner/Accused No.3 in Crl.P.No.11739 of 2025, Petitioner/Accused No.12 in Crl.P.No.11742 of 2025, Petitioner/Accused No.13 in Crl.P.No.11749 of 2025 and Petitioner/Accused No.8 in Crl.P.No.11753 of 2025, they shall be enlarged on bail subject to they executing a self-bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) each, with two sureties for the like sum each to the satisfaction of the arresting police officials. ii. The Petitioner/Accused No.9 in Crl.P.No.11737 of 2025, Petitioner/Accused No.14 in Crl.P.No.11738 of 2025, Petitioner/Accused No.3 in Crl.P.No.11739 of 2025, Petitioner/Accused No.12 in Crl.P.No.11742 of 2025, Petitioner/Accused No.13 in Crl.P.No.11749 of 2025 and 6 Petitioner/Accused No.8 in Crl.P.No.11753 of 2025 shall make themselves available for investigation as and when required. iii. The Petitioner/Accused No.9 in Crl.P.No.11737 of 2025, Petitioner/Accused No.14 in Crl.P.No.11738 of 2025, Petitioner/Accused No.3 in Crl.P.No.11739 of 2025, Petitioner/Accused No.12 in Crl.P.No.11742 of 2025, Petitioner/Accused No.13 in Crl.P.No.11749 of 2025 and Petitioner/Accused No.8 in Crl.P.No.11753 of 2025 shall not cause any threat, inducement or promise to the prosecution witnesses. iv. The Petitioner/Accused No.9 in Crl.P.No.11737 of 2025, Petitioner/Accused No.14 in Crl.P.No.11738 of 2025, Petitioner/Accused No.3 in Crl.P.No.11739 of 2025, Petitioner/Accused No.12 in Crl.P.No.11742 of 2025, Petitioner/Accused No.13 in Crl.P.No.11749 of 2025 and Petitioner/Accused No.8 in Crl.P.No.11753 of 2025 shall surrender their passports, if any, to the investigating officer.
