Case No. 86 of 2024, registered for the offences punishable under Sections 329(3), 332(a), 191(2), 190, 126(2), 115(2), 117(2), 109, 352 of B.N.S., Section 27 of the Arms Act and Sections 3(1)(r)(s) & 3(2)(va) of SC/ST Act. 3. At the outset, learned Special P.P. for the State submits that in this case, process of Section 82/83 of the Cr.P.C. has already been initiated against these appellants and as such, this appeal, filed for grant of anticipatory bail, is not Patna High Court CR. APP (SJ) No.1790 of 2025(3) dt.18-07-2025 2/2 maintainable, in view of several decisions of the Supreme Court, rendered in the case of (i) (Lavesh v. State (NCT of Delhi) reported in (2012) 8 SCC 730, (ii) State of MP v. Pradeep Sharma reported in (2014) 2 SCC 17, and (iii) Prem Shankar Prasad v. State of Bihar reported in 2021 SCC OnLine SC 955). 4.
