Pursuant to the order dated 04-09-2025 the father of the victim appeared through virtual mode from DLSA, Rajnandgaon and raised objection in granting bail to the applicant. His objection is taken on record. 2. Heard on the application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 (in short ‘B.N.S.S., 2023’). This is first bail application before this Court filed by the applicant for grant of regular bail. The applicant has been arrested on 13-08-2025 in connection with Crime No.414/2025 registered at P.S. -City Kotwali, Rajnandgaon (C.G.) for the offence under Section 74 of Bhartiya Nyay Sanhita, 2023 (in short ‘B.N.S., 2023”) and Section 8 of Protection of Children from Sexual Offences Act, 2012 (in short ‘POCSO Act’). 3. The case of the prosecution is that, on 09-08-2025 one FIR has been registered against the applicant with the allegation that the applicant is Head Digitally signed by MOHAMMED AADIL KHAN Date: 2025.09.22 18:47:51 +0530 2 Master of the Govt. Primary School Mohba and he sexually exploited and outraged the modesty of the girls students of the school and when the victims made complaint he threatened them. The father of one of the victims has lodged report to the police on which the FIR has been registered. The applicant has been arrested on 13-08-2025 and the investigation is going on. 4. Learned counsel for the applicant would submit that the applicant has been falsely implicated in the offence. Only on suspicion and to remove the applicant from the school he has been victimized. The applicant is suffering from Palpitation OCC and his treatment is going on. The applicant is in jail since 13-08-2025 and final adjudication of the case will take its own time. Therefore, the applicant may be enlarged on bail. 5. Learned counsel for the State opposes the bail application and has submitted that the applicant is Head Master of the school and he engaged in sexual exploitation of minor girl students and outraged their modesty. The victims have repeatedly made complaints against the applicant, but due to his dominating position no one came forward to lodge any complaint against the Head Master, ultimately father of one of the victims has lodged report against him in which the FIR has been registered. There are statement of the victims recorded during the investigation which clearly demonstrate the act of the applicant. Therefore, he is not entitled for bail. 6. I have heard learned counsel for the parties and perused the case diary. 7. Considering the submissions made by the learned counsel for the parties, considering the nature of allegation and the material collected during the investigation, further considering the statement of the victims recorded under Section 180 of B.N.S.S., 2023, I am not inclined to release the applicant on bail and accordingly his present bail application is rejected.
