HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 6097 of 2012 Court No. - 29 HON'BLE MAHESH CHANDRA TRIPATHI, J.
HON'BLE AMITABH KUMAR RAI, J.
1. List has been revised. None appears for the petitioners in revised call. Learned Standing Counsel appears for State respondents and Shri Anuj Srivastava appears for New Okhla Industrial Development Authority (in short "Noida").
2. The instant writ petition has been preferred for a direction to respondents to pay 64.70% additional amount of compensation along with remaining 5% developed area of the petitioner's acquired land.
3. Learned counsel for Noida submits that relief, prayed for, is not admissible in law in view of the Full Bench judgment of this Court in Gajraj & Ors. v. State of U.P. & Ors., 2011 (11) ADJ 1, wherein acquisition since 2000 has been considered. In the instant matter, the acquisition is of the year 1995, as such, no relief can be accorded at this stage.
4. Considering the facts and circumstances of the case, we do not find any merit in the instant matter. The writ petition stands dismissed accordingly.
