GP FOR HOME (AP) The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the inaction of the Respondent Nos.3 to 5 for not discharging their duties as per the Section 18A(a) of the SCs and STs (Prevention of Atrocities) Act, 1989 and also the Rule 5 of SCs and STs (Prevention of Atrocities) Rules, 1995 and also as per section 154 of Cr.P.C., which is clearly warrants the police officers to register the FIR 2 without preliminary enquiry and conduct the investigation and consequently direct the Respondents 3 to 5 to take necessary action in accordance with Section 18A(a) of the SCs and STs (Prevention of Atrocities) Act, 1989 and the Rule 5 of SCs and STs (Prevention of Atrocities) Rules, 1995.” 2. None represented for the Petitioner. 3. Sri V.Farooq, learned Assistant Government Pleader for Home would submit that, since the matter is of civil nature, Police have not registered the case. 4. Considering the submissions made, the Writ Petition is disposed of. However, Petitioner is at liberty to work out their remedies before appropriate forum in accordance with law. There shall be no order as to costs.
