JUSTICE VINOD KUMAR BHARWANI Order 17/02/2025 This petition has been filed on behalf of the petitioner under Section 528 B.N.S.S. against the order dated 15.12.2023 passed by Judicial Magistrate, Hindoli, District Bundi, in case No.28/2023 whereby the learned Trial Court dismissed the complaint filed by the petitioner. The aforesaid impugned order is a revisable order. Learned counsel for the petitioner submits that the petitioner-complainant has also filed a revision petition No.12/2024 titled as Ramraj Versus Durgalal & Ors. before the Additional District & Sessions Judge, District Bundi (Raj.) against the aforesaid order dated 15.12.2023. Later on the aforesaid revision petition has been transferred to the Special Court SC/ST Prevention of Atrocities, Bundi (Raj.), which is still pending. [2025:RJ-JP:6863] (2 of 2) [CRLMP-959/2025] Looking to the aforesaid facts & circumstances and in view of above, learned counsel for the petitioner has prayed that he may be permitted to withdraw the present petition. Permission, as sought for, is allowed. Accordingly, the instant petition is dismissed as withdrawn. Pending application(s), if any, also stands disposed of. However, the learned Trial Court is directed to expedite the disposal of Criminal Revision Petition No.31/2024 titled as Ramraj Vs. Durgalal & Ors. pending before the Special Court SC/ST Prevention of Atrocities, Bundi (Raj.) at the earliest. Office is directed to return the certified copies of the documents annexed thereto to the learned counsel for the petitioner after retaining photostat copies thereof on record.
