PUBLIC PROSECUTOR The Court made the following: ORDER: The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioners/ Accused Nos.1 and 2 on bail in Crime No.421 of 2025 of Pulivendula U/G Police Station, YSR Kadapa District, registered against the Petitioners/Accused Nos.1 and 2 herein for the offences punishable under Sections 103(1), 329(1), 115(2), 79 read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for short ‘the BNS’). 2. Heard the learned counsel for the petitioners and the learned Assistant Public Prosecutor. 3. The learned counsel for the petitioners submits that the Petitioners/Accused Nos.1 and 2 are innocent they were falsely implicated in this case, they have not committed any offence and they are sole breadwinners of their families. Petitioner No.2 is a student, they would abide by any condition to be imposed by this Court while enlarging them on bail. The deceased died after 10 days of the alleged incident because of the injuries, 3 there was no intention or motive. Charge sheet is already been filed and it is urged to enlarge the petitioners on bail. 4. Ms. P.Akhila Naidu, learned Assistant Public Prosecutor vehemently opposed to grant bail to the petitioners contending that accusation is well founded against the petitioners and urged to dismiss the petition. 5. As seen from the record, the petitioner No.1/ Accused No.1 caused simple injuries to LW1. Accused No.1 also caused the death of the deceased. Because of the injuries allegedly sustained by the husband of the de facto complainant in the hands of the petitioners, he was hospitalized for about 10 days and later he succumbed to injuries. The petitioners were arrested on 23.09.2025. They have been under judicial custody for the past 132 days. After thorough investigation, charge sheet has been filed. There are eyewitnesses LWs.1, 5, 6 and 8 who spoke against the petitioners. 6. Considering the gravity and nature of the allegations, as well as the facts and circumstances of the case, as accusation against the petitioners is well founded, therefore, this Court is not inclined to enlarge the Petitioners/Accused Nos.1 and 2 on bail at this stage. 7.
