JUSTICE M.I.ARUN ORAL ORDER The case of the petitioner is that her husband died on 18.10.2021. That her husband name is Narasimha Murthy and her name is Sujatha. However, in the death certificate, the name of the petitioner, who is the wife of the deceased Narasimha Murthy is shown as Shanthamma instead of Sujatha. It is further submitted that there is no such person as Shanthamma existing. The Writ Petition is filed with the following prayers: "(I) Issue a Writ of certiorari, or any other writ to quash/set aside the endorsement dated - 3 - HC-KAR NC: 2025:KHC:38574 WP No. 22958 of 2025 17.02.2025 passed by the Assistant Commissioner West Zone i.e., Respondent No.1 at Annexure-'G' vide No D¸Á¤ 12 dªÉÄ£ÉÆà 2023- 337 (E-1208275) and consequently a writ of mandamus to direct to respondents to rectify the death certificate of petitioner husband by name of wife as Sujatha instead of Shanthamma at Annexure 'E'. (II) To pass such other order/s, as this Hon'ble Court deems fit to grant in the circumstances of the case, in the interest of justice and equity." 2. The petitioner places reliance on the judgment of this Court in W.P.No.15937/2025 and W.P.No.6370/2024. 3. The learned counsel for the BBMP, upon instructions, submits that due enquiry will be conducted by the Registrar and appropriate orders will be passed and the present writ petition may be disposed of in terms of the order passed in W.P.No.6370/2024. 4. Hence, I proceed to pass the following: - 4 - HC-KAR NC: 2025:KHC:38574 WP No. 22958 of 2025 ORDER (i) The impugned endorsement dated 17.02.2025 (vide Annexure-G to the writ petition) passed by respondent No.1 is hereby set aside; (ii) Respondent No.2 is directed to consider the request of the petitioner by conducting the necessary enquiry as per Section 15 of the Registration of Births and Deaths Act read with the relevant Rules and also in the light of the order passed in W.P.No.6370/2024 and pass appropriate orders accordingly. The same shall be done within a period of one month from the date of receipt of a certified copy of this order; (iii) The writ petition stands disposed of accordingly.
