The Court made the following Order:
The petitioner had made an application for issuance of pattadar passbooks and for inclusion of his name in the adangal in relation to Ac.0.50 cents of land in Sy.No.251-4, Ac.0.18 cents of land in Sy.No.252-1, Ac.0.64 cents of land in Sy.No.252-7 and Ac.0.01 cents of land in Sy.No.253-4 of Chinna Chowk Village, Kadapa Mandal, YSR Kadapa District, on 03.01.2016, to the Tahsildar, Kadapa. This application was rejected by the Tahsildar, Kadapa, by way of an endorsement, dated 18.01.2016, on the ground that, the name of one Sri M. Venkata Sivaiah was registered against all this land and that the passbooks cannot be issued in favour of the petitioner. 2. The petitioner being aggrieved by this endorsement had approached this Court, by way of the present writ petition, contending that Mr. M. Venkata Sivaiah is the father of the petitioner, who had passed away and consequently the petitioner was entitled for mutation in his favour. This writ petition is said to have been allowed by the learned Single Judge of this Court on 27.12.2017, by setting aside the endorsement dated 18.01.2016 along with levy of costs of Rs.2,000/-. Aggrieved by the same, the respondents had moved W.A.No.518 of 2018, wherein, a Division Bench of this Court had set aside the levy of costs as well as the order and remanded the matter back to this Court. 4 HRRR,J W.P.No.42805 of 2017
3. The learned Government Pleader would contend that the application of the petitioner cannot be accepted as it is not in a prescribed format and has not been filed through proper channel. 4. There is no denial of the fact that Sri M. Venkata Sivaiah is the father of the petitioner. However, the learned Government Pleader would submit that an application under mee-seva scheme would have to be filed in the approved format. 5.
In the said circumstances, this writ petition is disposed of giving liberty to the petitioner to file an application, for issuance of pattadar passbooks and title deeds as well as for mutation of the revenue records, in the accepted format. Upon such application being made, the respondent-Tahsildar shall consider and pass necessary orders on the said application, within a period of six (06) weeks from the date of receipt of the application of the petitioner. 6. Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.
