Soni, learned counsel for the petitioner has submitted that Page No.# 2/2 earlier the present petitioner apprehended that he might be arrested in this case, but later on, he has been made a prosecution witness. His statement under Section 164 Cr.P.C has also been recorded. According to Mr. M. Soni, learned counsel for the petitioner, under given circumstances, this anticipatory bail application has become infructuous. After hearing both the sides and after considering the circumstances, this Court is of the opinion that the present anticipatory bail application has become infructuous and hence, stands closed and disposed of, accordingly.
