HIGH COURT OF JUDICATURE AT ALLAHABAD SPECIAL APPEAL No. - 1502 of 2013 Court No. - 29 HON'BLE MAHESH CHANDRA TRIPATHI, J. HON'BLE ANISH KUMAR GUPTA, J. 1. Heard learned counsel for the petitioner and Shri Ambrish Shukla, learned Addl. Chief Standing Counsel for State respondents. 2. The instant intra court appeal has been preferred challenging the judgment and order dated 5.9.2013 passed by learned Single Judge in Writ-A No.46257 of 2013 (Neeraj Kumar v. State of U.P. & Ors.). 3. Learned Addl. Chief Standing Counsel has stated that the impugned selection was finalized in May, 2010 and the petitioner had approached to the Writ Court in September, 2013 i.e after more than three years. Learned Single Judge had dismissed the writ petition by the impugned judgment and order on delay and laches with cogent reasons. Thereafter, atleast more than five recruitment processes had completed and as such at this belated stage no interference is required and the instant special appeal is liable to be dismissed. 4. Considering the facts and circumstances as well as the categorical objection raised by learned Addl. Chief Standing Counsel, we are not inclined to accord any reprieve to the petitioner in this intra court appeal. 5. The special appeal stands dismissed accordingly.
