GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the impugned action of respondents 3 and 4, in not taking any action on the complaint made by the Petitioner through Spandana dt. 14.11.2022, vide acknowledgment PET.I.D.TRPT/ TPUP/141122/03733, and further action of the Learned Presiding Officer, JFMC Court, Srikalahasthi, in not taking steps for considering and disposal of the complaint filed by the Petitioner U/s. 156(3) CrPC received has vide 2 CFR No. 3357 of 2022, on the file of JFMC Court Srikalahasti, as illegal and arbitrary, un-constitutional and contrary to law.” 2. Sri G.V.Shivaji, learned counsel for the Petitioner would submit that the learned Magistrate may be directed to consider the complaint filed by the Petitioner. 3. Sri V.Farooq, learned Assistant Government Pleader for Home, by way of counter affidavit, would submit that, the SHO, Srikalahasti has not received any direction to register FIR in CFR No.3357 of 2022 on the file of the Court of learned Judicial First Class Magistrate, Srikalahasti. 4. The information received from the concerned Court would show that the matter is coming up for recording the sworn statement of the Complainant. It is not the case that the private complaint has been forwarded to the Police for registration of any crime. 5. Considering the submissions, the Writ Petition is disposed of. However, the learned Magistrate is directed to conclude the proceedings as expeditiously as possible. There shall be no order as to costs.
