JUSTICE PRAVEER BHATNAGAR
Order 22/01/2025 The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No. 192/2024 registered at Police Station Harsora, District Kotputli-Behror for the offence(s) under Sections 189(2), 115(2), 126(2) and 333 of BNS.
Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated in this case. It is contended that after investigation police has submitted charge-sheet against the petitioner and other co-accused. It is contended that the father of the petitioner and complainant are real brother and there is a land dispute between the parties. It is further argued that altercation between the parties occurred suddenly and there was no pre-mediation on the part of the petitioner. The allegations against the accused-petitioner are omnibus in nature, accused
[2025:RJ-JP:3097] (2 of 3) [CRLMB-980/2025] party has also lodged a cross FIR against the complainant party in which Khetram, Madhi Devi and present petitioner also sustained injuries. The investigating officer after investigation also concluded that there is dispute of land between the parties and altercation took place suddenly and both the parties had spate. The accused petitioner is in custody since 23.12.2024 and the trial of the case will take considerable time, therefore, the benefit of bail may be granted to the accused-petitioner. Per contra, learned Public Prosecutor opposes the bail application. It is contended that as a result of assault injured Jale Singh sustained five injuries and other injured Prem Devi and Suresh have also sustained several injuries, injuries caused to Jale Singh at his head was found to be grievous in nature and similarly three other grievous injuries were found on the body parts of the Jale Singh, therefore, considering the nature of injuries caused to Jale Singh, bail application of the accused-petitioner deserves to be dismissed. Heard and perused the material available on record. Considering the arguments advanced by the counsel for the parties and looking to the fact that investigating officer in his conclusion has categorically stated that both the parties had a spate, it is admitted that a cross case was also lodged by the petitioner party against the complainant party in which the present petitioner Balram also sustained injuries alognwith the other persons of petitioner party i.e. Madhi Devi and Khetram, without further commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail.
[2025:RJ-JP:3097] (3 of 3) [CRLMB-980/2025] Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Balram S/o Babulal, in connection with FIR No. 192/2024 registered at Police Station Harsora, District Kotputli-Behror shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
