“10.1 That, that this Hon'ble Court may be pleased to direct the Respondent No. 3 to immediately lift the hold/freeze on the Petitioner's Bank of Baroda Current Account No. 31350200002049. 10.2 That, that this Hon'ble Court may further be pleased to direct the Respondent No. 4 (Bank of Baroda) to forthwith unfreeze the said account and allow the Petitioner full operational access upon receiving the necessary directive from Respondent No. 3 or from this Hon'ble Court. 10.3 That, that this Hon'ble Court may further be pleased to call for the entire records pertaining to the freezing of the Petitioner's account and the cyber fraud cases in connection with which the hold has been placed, to enable this Hon'ble Court to determine the legality and proportionality of the continued freezing. 10.4 That, that this Hon'ble Court may be pleased to grant any other relief as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case”

Learned counsel appearing for the petitioner submits that the Petitioner, who is a young entrepreneur operating his business in the name & style as "Nikhil Common Service Center," seeks immediate judicial intervention from this Hon'ble Court to unfreeze his current account (Account No. 31350200002049) maintained with respondent No. 4 Bank of Baroda, Bhatapara Branch.
The said account, crucial for his daily business operations and livelihood, was abruptly frozen on 02.05.2025, purportedly due to alleged cyber fraud originating from Jaipur, Rajasthan, and Surajpur, Chhattisgarh. The Petitioner has fully cooperated with the investigation, submitting Respondent No.3/SP a formal application to detailed on 06.05.2025 with relevant documents, and subsequently providing a statement along with relevant bank
3 transaction records 18.03.2025, which (specifically from 12.03.2025 to includes the single transaction of ₹25,000 from an unknown person). Despite this unreserved cooperation and no evidence of his involvement in any fraudulent activity, the account remains frozen, causing severe financial distress and violating his fundamental rights to carry on his trade and earn his livelihood. This petition seeks a Writ of Mandamus to compel the Respondents to rectify this arbitrary and unjust situation. 3. Learned counsel for the respondents oppose the submission made by counsel for the petitioner and contended that the matter relates to the cyber fraud, therefore, the petition may be dismissed. 4. I have heard learned counsel for the parties and perused the documents with utmost circumspection. 5. Considering the facts and circumstances of the case and submission made by learned counsel for the parties. Further considering the fact that in the aforesaid Bank account of the petitioner has been frozen on the direction of the respondent No.3 - Superintendent of Police and the matter of cyber fraud is under investigation, therefore, in view of the considered opinion of this Court, this petition is not maintainable. 6. Accordingly, the petition being devoid of any merit is liable to be and is hereby dismissed. Sd/-
