Sri G.Arun Showri, learned counsel for the petitioner and 2. Ms. K.Priyanka Lakshmi, learned Assistant Public Prosecutor appearing on behalf of the State. Learned counsel would submit that the petitioner is aged about 74 years 3. / and he is residing in Banglore. As such, he could not appear before the Court for 251 Cr.P.C examination. The learned trial Judge issued a Non-Bailable- Warrant against him. A petition was filed to recall such warrant and that was dismissed stating that photocopy of medical certificate is not maintainable. Learned counsel would further submit that because of his health condition, he could not appear before the Court and his absence is not intentional or deliberate.
