1. Grievance of the petitioner is that petitioner was assaulted and harassed by villagers, however, even when he approached the Police Station for registering of the FIR, his complaint was not registered. 2. Petitioner submits that he received grievous injuries on various parts of his body, for treatment he was initially sent to primary health centre from where he was referred to CIMS Hospital, Bilaspur . However, when no FIR was registered, he moved an application under Section 175(3) and Section 223 of Bhartiya Nagrik Suraksha Sahinta, 2023 which is pending consideration. 3.
Perusal of order sheet of learned Judicial Magistrate First Class, Palmgarh, District Janjgir-Champa, Chhattisgarh, would show that the
3 application under Section 175(3) and Section 223 of Bhartiya Nagrik Suraksha Sahinta, 2023 was filed by petitioner and thereafter, learned Judicial Magistrate has fixed the case and called for the report from concerned Police Station and recording of statement of the complainant. The next date fixed by learned Magistrate is 22.09.2025. 4. In the aforementioned facts of the case, this criminal miscellaneous petition filed by petitioner is premature, accordingly, it is dismissed at this stage, reserving liberty with petitioner to repeat the prayer before an appropriate forum, if any occasion arises in future. sd/- (Parth Prateem Sahu) alfiza Judge
