SATAPATHY Order No. ORDER(ORAL) 17.02.2026 07. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode). 2. Since these two bail applications arise out of one and same case record, the same are heard together and disposed of by this common order with the consent of the learned counsel for the parties. 3. These are the bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection with Special GR Case No. 09 of 2025 arising out of Padampur PS Case No. 49 of 2025 pending in the file of learned Special Judge-cum-ADJ, Padampur for commission of offences punishable U/Ss. 111(2)(b) of BNS r/w Sections 21(C)/25/29 of the NDPS Act, on the main allegation of assisting the co-accused for possessing 619 ml of Pentazocine Injection & 174 bottles of WINCEREX Cough Syrup and thereby, committing organized crime. 4. Heard, Mr. Sarat Kumar Jena, learned counsel for the Petitioner in BLAPL No. 10216 of 2025; Mr. Sushanta Kumar Mohanty, learned counsel for the Petitioner in BLAPL No. 12482 of 2025 and Mr. T.K. Acharya, learned Additional Public Prosecutor in the matter and perused the record. 5. Admittedly, the Petitioners were not apprehended from the spot, rather they were subsequently apprehended in this case, however, the Petitioners are in custody since 14.07.2025 and in the meantime, charge sheet has already been submitted. There are 21 charge sheeted witnesses in this case and the trial would definitely take some more time. It is submitted that the Petitioners are implicated in this case on the basis of statement of co-accused Bitu @ Bhimsen Karei. In the aforesaid facts and circumstance, especially when there is no immediate prospect of trial and taking into account the mode and manner of implication of the present Petitioners in this case, this Court considers that the Petitioners have satisfied the conditions of Sec. 37 of NDPS Act. 6. For the reasons stated hereinabove and regard being had to the pre-trial detention of the Petitioners in custody and keeping in view grant of bail to co-accused Kanha Bhue, Sujit Kumar Sahu by this Court in BLAPL Nos. 9123 & 8417 of 2025 and extending the petitioner with the benefit of the order passed in ABLAPL No. 5153 of 2025 to co-accused Narendra Behera, this Court without expressing any view on merit admits each of the petitioners to bail. 7. Hence, these two bail applications of the petitioners namely Pradeep Kumar Sahu @ Sachin & Ramakanta Mishra @ Bachun in BLAPL Nos. 10216 & 12482 of 2025 are allowed and each of the petitioners is allowed to go on bail on furnishing bail bonds of Rs.50,000/- (Rupees Fifty Thousand) each with two solvent sureties for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it. 8. Accordingly, these BLAPL Nos. 10216 & 12482 of 2025 stand disposed of. Issue urgent certified copy of the order as per Rules. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference. (G.
