JUSTICE MOHAMMAD NAWAZ ORAL ORDER Petitioner is praying to enlarge him on bail in SC No.230/2021 pending before the LXV Additional City Civil and Sessions Judge, Bengaluru (CCH-66), arising out of Cr.No.103/2020 of Upparpet Police Station, Bengaluru City, registered for the offence punishable under Section 397 of IPC. 2. The material on record reveal that, petitioner was granted bail by the Sessions Court in Crl.Misc.No.134/2021 vide order dated 19.1.2021. He was subsequently taken into custody in another case and remained in custody till 31.12.2022, on which date he was brought under body warrant in the present case. Thereafter, he was in custody till 16.4.2025, on which day he was enlarged on bail. On 19.5.2025, when the case was called, petitioner/accused as well as his counsel remained absent and therefore, NBW was issued against - 3 - HC-KAR NC: 2025:KHC:38335 CRL.P No. 12518 of 2025 the petitioner. He was arrested and produced before the Court on 6.6.2025 and in custody since then. 3. It appears that on one day i.e., 19.5.2025, as the petitioner and his counsel remained absent, the learned Sessions Judge issued NBW against the petitioner. It is no doubt, the petitioner has violated the conditions imposed by not appearing before the Court, as one of the conditions stipulated that he shall regularly appear before the Court on future hearing. However, considering the fact the petitioner has now undertaken that he will regularly appear before the trial Court without fail, an opportunity can be given, making it clear that no further indulgence will be shown to the petitioner if the bail conditions are violated. Hence, the following: ORDER I. Petition is allowed. II. Petitioner/accused in SC No.230/2021 pending on the file of the LXV Additional City Civil & Sessions Judge, Bengaluru City, (Cr.No.103/2020 of - 4 - HC-KAR NC: 2025:KHC:38335 CRL.P No. 12518 of 2025 Upparpet Police Station), Bengaluru City, shall be enlarged on bail, subject to following conditions: 1. He shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees one lakh only), with two sureties for the likesum to the satisfaction of the jurisdictional Court. 2. He shall furnish proof of his residential address and shall inform the Court, if there is change in the address. 3. He shall not directly or indirectly tamper with the prosecution witnesses. 4. He shall not indulge himself in committing any offence. 5. He shall appear before the trial Court regularly on all dates of hearing.
