1.PUBLIC PROSECUTOR The Court made the following: ORDER: Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the petitioner/Accused No.2 on bail in Crime.No.27 of 2022 of
2 Prohibition & Excise Police Station, Bheemunipatnam, Visakhapatnam District, registered against the petitioner/Accused No.2 herein for the offences punishable under Sections 20(b)(ii)(c), 25 read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 19851. 2. Heard the learned counsel for the petitioners and the learned Assistant Public Prosecutor. Perused the record. 3. As seen from the record, the allegation against the petitioner/Accused No.2 is that in the year 2022 she was indulged in dealing with 80 Kgs of Ganja which is a commercial quantity. After thorough investigation chargesheet has been filed. Except the confession of the other Accused no incriminating material is available against the Petitioner. The Petitioner is a female, aged about 39 years. She was arrested on 12.08.2025. She has been in the judicial custody for the past 80 days. The petitioner/Accused No.2 is a permanent resident of G.K.Veedhi, Visakhapatnam. She has got fixed abode. 4. Considering the facts and circumstances of the case, the nature and gravity of allegations levelled against the petitioner/Accused No.2, this Court is inclined to enlarge the petitioner/Accused No.2 on bail with the following stringent conditions: i. The petitioner/Accused No.2 shall be enlarged on bail subject to she executing a personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) each with two sureties each for the like sum each to the satisfaction of 1 the NDPS Act
3 the learned XV Additional Judicial Magistrate of First Class, Bheemunipatnam. ii. The petitioner/Accused No.2 shall appear before the learned Trial Court on each and every adjournment without fail.
In the event of failure to appear before the learned Trial Court, the learned Trial Court is at liberty to proceed in accordance with law to secure the presence of the petitioner/Accused No.2. iii. The petitioner/Accused No.2 shall not leave the limits of the District without prior permission from the Station House Officer concerned. iv. The petitioner/Accused No.2 shall not commit or indulge in commission of any offence in future. v. The petitioner/Accused No.2 shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court. vi. The petitioner/Accused No.2 shall cooperate with the investigating officer in further investigation of the case and shall make themselves available for interrogation by the investigating officer as and when required. 5.
