Shri Bharadwaj submits that in the CIS software, the date of hearing was shown differently and therefore, the Complainant could not appear on the said date but the trial Court, by invoking the power under Section 256 Cr.P.C, has closed the complaint case and acquitted the accused/Respondent. 5. Taking into consideration the submission made by learned Counsel for the Petitioner, leave as prayed for is granted. 6. Let the Petition filed by the Petitioner be registered as Acquittal Appeal. 7. Also heard on admission of Acquittal Appeal. 8. Appeal is admitted for hearing. 9. Notice be issued to the accused/Respondent on payment of PF as per rules. 10.
