Applicant has filed this first bail application under Section 483 of Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail as he has been arrested in connection with Crime No. 61/2025 registered at Police Station – Deori, District - Balod (C.G.) for offence punishable under Section 65(1), 308(4), 351(1), 351(2), 351(3), 49 of BNS, 2023 and Section 4(2), 17 of POCSO Act, 2012. 2. Case of the prosecution is such that, on 16.06.2024 applicant took the victim on his bike to the house of one Arvind Sahu, where applicant ALFIZA BAIG Digitally signed by ALFIZA BAIG Date: 2025.09.22 17:03:24 +0530 2 forcibly established physical relation with her and took her photographs. After that applicant used to ask for money from the victim by blackmailing her that if she refuse to give money he will make her photographs viral and even threatened her to kill her parents. Based upon aforementioned crime was registered and applicant was arrested on 23.05.2025. 3. On 18.09.2025 mother of the victim appeared before this Court through virtual mode and raised objection in grant of bail to the applicant. 4. Learned State counsel would submit that according to document available in case diary age of the victim on the date of incident was about 13 years and 7 months. Referring to deposition of victim which is filed as Annexure A-3, he would submit that victim stood with the allegation. 5. I have heard learned counsel for the State and perused the documents enclosed along with the bail application. 6. Taking into consideration facts and circumstances of the case, nature of allegation, submission made by learned counsel for the State with regard to the age of the victim which was 13 years and 07 months on the date of accident, as also document enclosed along with the bail application, I do not find present to be a fit case to allow the application, accordingly, the application is dismissed.
