POONACHA ORAL ORDER (PER: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE) 1. The complainant has filed the present complaint inter alia alleging wilful disobedience of the order dated 05.06.2024 passed by the learned Single Judge in W.P. No.9701/2024 [LB-Res]. The operative part of the said order reads as under: 9. The writ petition is accordingly disposed of, directing the Commissioner, Udupi City Municipality to reconnect the sewerage line to the premises of the petitioner as expeditiously as possible and at any rate within a period of seven (7) days from the date of receipt of copy of this order. All contentions are kept open to be considered by the civil court in the suit. Any observations made during the - 3 - HC-KAR NC: 2025:KHC:39907-DB CCC No. 651 of 2024 course of this order shall not affect the rights of any of the parties before the civil court. 2. This Court is informed that the concerned authority has reconnected the sewerage line to the premises of the petitioner pending further proceedings. However, it is the complainant's contention that objections have been raised in proceedings initiated under Section 197 of the Karnataka Municipalities Act, 1964 and therefore, the connection provided is only considered as temporary. 3. We note that the order dated 05.06.2024 is the subject matter of two appeals being W.A. No.1031/2024 and W.A. No.959/2024. In view of the above, we consider it apposite to close the present complaint. It is needless to say that the connection granted to the complainant in compliance of the order dated 05.06.2024 would be subject to further orders that may be passed by this Court in the appeals.
