JUSTICE KALYAN RAI SURANA ORDER Date : 27-02-2025 Heard Mr. T. Tapak, learned counsel for the applicant and Ms. R. Basar, learned Addl. Senior Govt. advocate appearing for the respondent nos. 1 to 3. 2. By an order dated 27.01.2025 passed in WP(C) 646(AP)/2016, this Court had rejected the prayer made by the learned counsel for the applicant requiring some more time to take steps for service of notice on the respondent nos. 4 and 5 by way of dasti, as the order for dasti service was passed on 10.06.2024, which was returnable in 4(four) weeks. Accordingly, on failure of the applicant to serve notice on the respondent nos. 4 and 5, the Court was inclined to strike out their names at the risk of the applicant. 3. The learned counsel for the applicant has submitted that on earlier occasion steps were taken, but the notice could not be served. It is submitted that in the absence of respondent nos. 4 and 5, even if the connected writ petition is allowed, it would not serve any purpose. Accordingly, the learned counsel for the applicant submits that this application has been filed for review of the order dated 27.01.2025 passed in WP(C) 646(AP)/2016. 4. The learned Addl. Senior Govt. advocate, in her usual fairness has not Page No.# 4/4 seriously opposed this application. 5. Considering the submissions that for an effective adjudication of the connected WP(C) 646(AP)/2016, the presence of respondent nos. 4 and 5 is required, the prayer made in this interlocutory application, is allowed. Accordingly, the name of respondent nos. 4 and 5 in the connected WP(C) 646(AP)/2016 stands restored. The applicant shall provide a freshly typed out cause title of the said writ petition to the Registry of Itanagar Permanent Bench so as to incorporate the same in the record. 6. This interlocutory application stands disposed of. 7. Let the connected WP(C) 646(AP)/2016 be listed in the week commencing 03.03.2025, on a date convenient to the Registry so as to enable the learned counsel for the petitioner to seek a fresh direction for service of notice on respondent nos. 4 and 5 by registered post with A/D as well as by dasti service.
