HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Review Petition (Writ) No. 118/2022 In S.B. Civil Writ Petition No.17996/2017 1. State Of Rajasthan, Through Principal Secretary, Deparment Of Local Self, Government Secretariat, Jaipur 2. Director, Department Of Local Bodies, G-3, Rajmahal Residency, Near Civil Lines Phatak, C-Scheme, Jaipur. 3. Rajasthan Municipalities Administrative And Technical And Subordinate, And Ministerial Services Selection Commission, G-3, Rajmahal Residency, Near Civil Lines Phatak, C-Scheme, Jaipur. Through Secretary. ----Petitioners Versus Madhu Rao D/o Hari Singh Rao, R/o New Bus Stand Nawan Road, Near Dak Bangla, Sambhar Lake, District Jaipur. ----Respondent For Petitioner(s) : Mr. G.S. Gill, AAG assisted by Ms. Shikha Sharma AAAG For Respondent(s) : Mr. Devendra Kumar Bhardwaj Advocate. HON'BLE THE ACTING CHIEF JUSTICE MR. SANJEEV PRAKASH SHARMA Order 10/10/2025 1. The review petition has been filed assailing the order dated 30.09.2021, whereby this Court directed for measurement of the respondent-writ petitioner’s to be done afresh by All India Institute of Medical Sciences, Jodhpur in terms of earlier similar order relating to other candidates having been passed by Coordinate Bench of this Court on 18.04.2017. 2. Learned counsel for respondent-writ petitioner submits that the height and chest measurements were the issues involved in (2 of 2) [WRW-118/2022] the order dated 18.04.2017 passed by the Coordinate Bench of this Court, whereas in the present case, the respondent-writ petitioner’s weight found to be 47.4 kgs instead of 47.5 kgs, was the issue, which resulted in rejection of her candidature. Learned counsel, therefore, submits that the order passed in the case of other candidates could not have been relied upon by this Court. 3. I have considered the submissions. 4. I find that the respondent-writ petitioner was ousted from the medical on the basis of weight being less by 100gms. Considering that Coordinate Bench even allowed revision of medical norms relating to height and chest measurements. There was no occasion for not allowing a candidate’s weight to be re-examined. Moreover, if a person’s weight is less by 100gms, the same can only be a temporary unfitness and not a permanent unfitness for denying appointment. 5. I, therefore, do not find any reason to review the order dated 30.09.2021. The review petition is, therefore, dismissed. 6. All pending application, if any, stand disposed off.
