ORDER: The Criminal Petition has been filed under Sections 480 and Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), 483 of the seeking to
2 enlarge the Petitioners/Accused Nos.1 & 2 on bail in Crime No.329 of 2025 of Kovur Police Station, Sri Potti Sriramulu Nellore District, registered against the Petitioners/Accused Nos.1 & 2 herein for the offences punishable under Section 8(c) red with 20(b)(ii)(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for brevity ‘the NDPS Act’). Heard the learned counsel for the petitioner and the learned Assistant
2. Public Prosecutor. Perused the record. As seen from the record, the Petitioners/Accused Nos.1 and 2 were
3. allegedly in possession of 3.935 kgs of Ganja and transporting it. They were arrested on the spot. The seized contraband is not a commercial quantity. There are no similar adverse antecedents reported against the petitioners. Of course. Petitioner No.1 was alleged to have committed an offence punishable under the provisions of ‘the I.P.C.,’ and Petitioner No.2 was alleged to have committed two offences punishable under the provisions of ‘the I.P.C.
4. However, the learned Counsel for the Petitioners submit that the cases registered under the provisions of ‘the I.P.C.,’ were ended in acquittal. Petitioners are permanent residents of Ramatheertham Village and Koduru Patha Palem Village, Nellore City. There is a fat chance for the Petitioners to escape from the clutches of law, if they are enlarged on bail as they have got a fixed abode. If they are enlarged on bail with certain stringent conditions they may not evade from the process of law. So far seven witnesses were examined. They are all official and material witnesses. Substantial portion of the investigation was completed. The petitioners were arrested on 25.11.2025. 3 they have been in the judicial custody for the past 31 days. No application was filed seeking for custodial interrogation of the petitioners. 5. Considering the gravity of the case and the nature of the allegations completion of material portion of the investigation, in the circumstance of the case, this Court is inclined to enlarge the Petitioners/Accused Nos.1 & 2 on bail with certain stringent conditions. 6. In the result, the Criminal Petition is allowed with the following stringent conditions: The Petitioners/Accused Nos.1 & 2 shall be enlarged on bail subject to them executing bond for a sum of Rs.
10,000/- (Rupees Ten thousand only), with two sureties each for the like sum each to the satisfaction of the learned Additional Judicial Magistrate of First Class, Kovur. The Petitioners/Accused Nos.1 & 2 shall not leave the limits of the State of Andhra Pradesh without prior permission from the Station House Officer concerned. The Petitioners/Accused Nos.1 & 2 shall not commit or indulge in commission of any offence in future. The Petitioners/Accused Nos.1 & 2 shall cooperate with the investigating officer in further investigation of the case and shall make themselves available for interrogation by the investigating officer as and when required. The Petitioners/Accused Nos.1 & 2 shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the court or to any police officer.
