JUSTICE MOHAMMAD NAWAZ ORAL ORDER Petitioner is seeking to release her on anticipatory bail in a case registered in Cr.No.169/2025 at Koramangala Police Station, Bengaluru City, for the offence punishable under Section 80(2) of BNS, 2023. 2. Heard the arguments and perused the material on record. 3. FIR is registered on a complaint lodged by Tamilarasi, against one S.Bhuvaneshwaran/accused No.1 and petitioner/accused No.2. 4. As per complaint averments, complainant’s daughter by name P.R.Varsha, married to accused No.1 on 23.11.2023, committed suicide by hanging herself on 21.6.2025 at 11.30 a.m. in her matrimonial home. - 3 - HC-KAR NC: 2025:KHC:32684 CRL.P No. 11258 of 2025 5. Accused No.1 is the husband and accused No.2/petitioner is the mother-in-law of the deceased. 6. It is alleged by the prosecution that complainant’s daughter committed suicide on account of the harassment meted to her for dowry by both the accused. 7. A perusal of the complaint averments goes to show that at the time of marriage, complainant gave 100 sovereigns of gold and Rs.1,00,000/- of cash as dowry and she spent approximately Rs.3 lakhs for the marriage function. It is alleged that the petitioner repeatedly pressurized the complainant’s daughter to purchase a house in Nagarcoil and in the month of December, 2023 complainant gave Rs.4 lakhs. Further, petitioner complained that complainant’s daughter has stolen all the jewellery but actually they were kept by the petitioner. 8. Learned HCGP has contended that there is a prima facie case against the petitioner for having - 4 - HC-KAR NC: 2025:KHC:32684 CRL.P No. 11258 of 2025 committed dowry death. He contended that investigation is under progress and therefore, the petitioner is not entitled for the relief sought in the petition. 9. A careful perusal of the complaint averment goes to show that on the date of committing suicide i.e., on 19.6.2025, the deceased as well as her husband i.e., accused No.1 quarrelled and the deceased sent a audio through Whatsapp to the complainant. It is alleged that the recorded version clearly depicts that accused No.1 was the real cause for the death. The allegations in the complaint that the petitioner was pressurizing the deceased to purchase a house and there was demand of dowry etc. is a matter to be established in due course. In the complaint itself it is stated that Rs.4 lakhs was given to accused No.1 to purchase goods for the new house. 10. In the above facts and circumstances and for the forgoing reasons, by imposing necessary conditions, - 5 - HC-KAR NC: 2025:KHC:32684 CRL.P No. 11258 of 2025 the relief sought by the petitioner/accused No.2 can be granted. Hence, the following: ORDER 1. Petition is allowed. 2. Petitioner/accused No.2 in Crime No.169/2025 registered by Koramangala Police Station, shall be released in the event of her arrest, subject to following conditions: a) She shall appear before the Investigating Officer within one week from the date of receipt of a copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees one lakh only) with two sureties for the likesum. b) She shall furnish her residential address/contact number and shall inform the I.O. in case of change in the address/contact number. c) She shall co-operate with the investigation of the case. - 6 - HC-KAR NC: 2025:KHC:32684 CRL.P No. 11258 of 2025 d) She shall not tamper with the prosecution evidence/witnesses either directly or indirectly. e) She shall be regular in attending the Court proceedings.
