Machine bearing registration number AP 30V4642, which was stolen and not competing the investigation into Crime in FIR No FIR No 157/2022 Dated 29.12.2022 on the file of the Santhakaviti Police Station, Vizianagaram District which was registered for above crime which is highly illegal, unjust, arbitrary and contrary to law and violative of Articles 14 and 21 of Constitution of India and consequently direct the Respondents to find out the Petitioners Vardhaman Grain Processing Machine by competing the investigation in the above crime and pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents to forthwith immediately take necessary steps to find out the Petitioners Vardhaman Grain Processing Machine bearing registration number AP 30V4642 in FIR No 157/2022 Dated 29.12.2022, pending disposal of the above writ petition and pass Counsel for the Petitioner:

ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…to issue a writ or order or direction more particularly one in the nature of WRIT of MANDAMUS aggrieved by the impugned action of the Respondents failure to trace the Petitioners Vardhaman Grain Processing Machine bearing registration number AP30 V 4642, which was stolen and not competing the investigation into Crime in FIR No.157/2022 Dated 29.12.2022 on the file of the Santhakaviti Police Station, Vizianagaram District which was registered for above crime which is highly illegal, unjust, arbitrary and contrary to law and violative of Articles 14 and 21 of Constitution of India and consequently direct the Respondents to find out the Petitioners Vardhaman Grain Processing Machine by competing the investigation in the above crime and pass.…”
2. Heard Sri S.Srinivasa Rao, learned counsel for the petitioner and Sri V.Farook, learned Assistant Government Pleader for Home for the official respondents.
3. Learned Assistant Government Pleader for Home, on written instructions, would submit that the investigation is concluded in this matter. The respondent-police have made all efforts and could not trace the subject machine. The 5th respondent obtained “Undetectable Orders” from the 3rd respondent vide C.No.21/Ref/SDPO-CPP/2025 dated 14.02.2025, with a note that the case would be reopened if any fresh clue comes to light.

Learned counsel for the petitioner would submit that recording the same, the petition may be disposed of.
5. Recording the above said submission, this Writ Petition is disposed of. There shall be no order as to costs. However, the petitioner is at liberty to work out his remedies before the appropriate forum according to law.
