JUSTICE MOHAMMAD NAWAZ ORAL ORDER Petitioners are seeking to quash the proceedings arising out of Crime No.73/2025 of Kumaraswamy Layout, Police Station, Bangalore City. - 4 - HC-KAR NC: 2025:KHC:44411 WP No. 30217 of 2025 C/W WP No. 32343 of 2025 2. FIR is registered on a complaint lodged by one Mohammad Noor against Jeelan Pasha and two unknown persons for the offence punishable under Section 127(2), 140(3), 351(3) of BNS, 2023. 3. In brief, it is alleged in the complaint that on 26.03.2025 at about 10:30 a.m., the first informant was informed by one Mohammed Saqlain over phone that at about 6:30 a.m., three persons have abducted his son Mohammad Ghouse and at about 12:30 p.m., accused Jeelan Pasha telephoned to him and threatened him with dire consequences etc., saying that if he did not bring one Mustafa, they will commit the murder of his son. 4. From the material on record, it can be seen that a person by name Mohammad Mustafa, a relative of the first informant had cheated many persons by receiving money from them. The allegations are that in that background, the petitioners have abducted the first informant’s son and then threatened him over phone etc. - 5 - HC-KAR NC: 2025:KHC:44411 WP No. 30217 of 2025 C/W WP No. 32343 of 2025 5. FIR is registered against accused No.1/petitioner in W.P.No.30217/2025. In the remand application, one Mohammad Ismail has been arraigned as accused No.2. He is the petitioner in W.P.No.32343/2015. 6. Joint applications are filed in both the petitions under Section 528 of BNSS, stating that the parties have amicably settled their differences and decided to close all disputes between them once for all. 7. It is submitted that respondent No.2/defacto, complainant has no objection for quashing the criminal proceedings pending against the petitioners. 8. Petitioners as well as respondent No.2 and the victim viz., Mohammad Ghouse are present before the Court. They submit that they have settled all the disputes among themselves. Respondent No.2 and his son Mohammad Ghouse submits that in view of the settlement they are not interested in proceeding with the criminal - 6 - HC-KAR NC: 2025:KHC:44411 WP No. 30217 of 2025 C/W WP No. 32343 of 2025 case initiated against the petitioners, any further and they have no objection for quashing the proceedings. 9. Even though the offences are non- compoundable in nature, in view of the settlement between the parties, no useful purpose will be served in continuing the proceedings. 10. It is well settled that in exercise of its inherent powers, this Court can quash criminal proceedings or FIR or complaint, and Section 320 of the Code does not limit or affect the powers under Section 482 of the Code (528 of BNSS, 2023). 11. In the light of the Joint memo filed by the parties, continuation of proceedings will be a futile exercise. Therefore, the following: ORDER Applications filed in both the petitions are allowed.
