Broadly speaking, the learned trial court partially allowed the interim injunction application thereby restraining the defendant/respondent from creating third party interest in the subject property but disallowed the interim injunction application as regards relief seeking to restrain the respondent/defendant from interfering with possession of the petitioner/ counter-claimant over the subject property. The reason for denying the relief related to possession, as recorded in the impugned order is that vide paragraph 20 of the counterclaim, the present petitioner/counter-claimant herself pleaded that the suit property has been locked by the present respondent.
