2 High Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, to declare the action of the respondent authorities in not allowing the petitioner to participate in the Tender held on 5.6.2014 with regard to the catering contract in the 6th respondent school pursuant to the notification dated 22.5.2014 bearing Rc.No.C4/Tender/2014-15 without assigning any reason, and accepting the tender of the 7th respondent who quoted less rate than the previous year, as being illegal, arbitrary and unconstitutional and consequently direct the respondents to issue fresh tender notification and to accept the tender in accordance with law. The Court made the following ORDER:
The present Writ Petition has been filed for the following relief.
“………to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, to declare the action of the respondent authorities in not allowing the petitioner to participate in the Tender held on 05.06.2014 with regard to the catering contract in 6th respondent – School pursuant to the notification in Rc.No.C4/Tender/2014-15, dated 22.05.2014, without assigning any reason and accepting the tender of 7th respondent, who quoted less rate than the previous year, as being illegal, arbitrary and unconstitutional and consequently direct the respondents to issue fresh tender notification and to accept the tender in accordance with law.”
2. Today, when the matter came up for hearing, learned counsel for the petitioner submits that due to efflux of time, cause in the Writ Petition does not survive for adjudication and the matter has become infructuous. 3. Recording the said submission, the Writ Petition is dismissed as infructuous. There shall be no order as to costs. SRK, J WP No.16916 of 2014
