Heard the learned counsel for petitioner, learned High Court Government Pleader for the State and perused the material on record. 2. Crime No.101/2025 of R.T. Nagar Police Station, Bengaluru City is registered for the offence punishable under Section 354(C), 354(D), 376, 384, 420, 506 and 500 of IPC, and Section 66(E) and 67 of the Information Technology Act, 2000. 3. This petition is preferred under Section 483 of the BNSS, 2023, to enlarge the petitioner on bail. 4. It is the case of prosecution that complainant's daughter is working as a constable (CRPF) and the

accused/petitioner is also working in CRPF. It is alleged, the petitioner in the guise of marriage gave drugs to the complaint's daughter and committed rape on her and without her knowledge recorded the act and took pictures and then blackmailed and extracted Rs.11,00,000/- from her. Further, when the victim was engaged to another boy, he sent the photos and videos to him, as a result of which, victim's marriage was cancelled. 5. It is contended by the learned counsel for petitioner that the entire allegations are false, petitioner is innocent. He contended that, if the petitioner has committed any such offence as alleged, a complaint would have been lodged immediately, on the other hand, the complaint is lodged after an inordinate delay. He further contended that complainant has refused to undergo medical test and therefore, there is no material collected by the prosecution to show that she was drugged and raped by the petitioner. It is submitted that the petitioner is working as a constable for the last 23 years without any

blemish and in view of his detention in judicial custody, his entire family members are suffering, as he is the only bread winner of the family. 6. Learned Additional SPP has contended that allegations are serious in nature and the victim has categorically stated that she was drugged and raped by the petitioner and then he blackmailed and extracted Rs.11,00,000/- from her. She contended that, since the petitioner was continuously blackmailing the victim, she being unable to tolerate the torture, lodged the complaint and therefore, there is no delay in lodging the compliant.
Further, contended that the investigation is under progress and therefore, at this stage, if the petitioner is released on bail, there are chances of tampering the witnesses and destroying the evidence. 7. I have perused the statement of the victim recorded under Section 183 of the BNSS, 2023. Serious allegations are made against the petitioner. It cannot be said that the allegations are entirely false. Since the

investigation is not completed, at this stage, this is not a fit case to enlarge the petitioner on bail. Chances of tampering the witnesses, in case bail is granted to the petitioner at this stage, is not ruled out. Petition is dismissed. Sd/- (MOHAMMAD NAWAZ) JUDGE
