CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 3 02-09-2025 Both these applications are arising out of the same P.S. Case, hence, they are being heard together and are being decided by a common order.
2. Heard the learned Senior counsel for the petitioner(Praveen Kumar Yadav), Mr. Rajesh Kumar Singh, the
learned counsel for the petitioner (Ram Pravesh Kumar), Mr.
Patna High Court CR. MISC. No.29804 of 2025(3) dt.02-09-2025 2/3 Sanjay Kumar Tiwary and learned APP for the State, Mr. Jharkhandi Upadhyay.
3. The petitioners seek regular bail in connection with Rohtas (Cyber) P.S. Case No. 18 of 2025 registered for the offence under Sections 303(2), 319(2), 318(4) of the Bharatiya Nyaya Sanhita, 2023 and under Sections 66© and 66(D) of the IT Act.
4. It is a case of cyber fraud. The petitioners are accused of cheating innocent people through online transaction.
5. So far as the petitioner namely Praveen Kumar Yadav @ Gautam Kumar is concerned, he is found to be involved in cyber fraud. His name has come in the confessional statement of co-accused. He used to provide mule accounts. He is in custody since 07.03.2025.
6. So far as the petitioner namely Ram Pravesh Kumar is concerned, he is the account holder of the mule account. He is in custody since 07.03.2025.
7. Learned A.P.P. for the State has vehemently opposed the prayer for bail.
8. Considering the facts and circumstances of the case as well as the nature of the allegation levelled against the petitioners, I am not inclined to grant regular bail to the
Patna High Court CR. MISC. No.29804 of 2025(3) dt.02-09-2025 3/3 petitioners.
9. Accordingly, these applications for regular bail stand rejected.
